How Expungement Laws in Virginia Can Benefit You

Under Virginia Code § 19.2-392.2, certain criminal charges may be expunged if the defendant was found not guilty (acquitted), the charge was nolle prosequi (dropped by the prosecutor) or was otherwise dismissed. However, charges that resulted in a conviction cannot be expunged under current Virginia law.

When a charge is expunged, it is completely removed from both your criminal record and the court’s records. This means your criminal history will no longer show that you were ever arrested or charged, and the case will also be deleted from the Virginia Case Information System, making it inaccessible to the public.
